The Challenge
Our client wished to take a short-term let of a 30,000 sq ft warehouse in West Yorkshire, which also comprised offices, parking and a shared service yard. The poor condition of the property at lease commencement meant that the client sought to limit its dilapidations liability on the short-term let. We were instructed to prepare a photographic schedule of condition in short timescales to record the condition of the premises immediately prior to lease commencement.

The Results
- Our report was prepared promptly, ensuring the letting was not held up, reducing potential risk of delayed occupancy for the client.
- We provided additional expert advice, identifying landlord’s plant in a number of locations, removing them from the tenant’s demise.
- We reviewed the draft lease and suggested to the solicitor a number of amendments that were incorporated into the lease to limit the tenant’s repair liability significantly more than originally proposed.
- The tenant was able to occupy the premises as planned with future liabilities limited significantly, with a more accurately defined extent of demise than originally proposed.
