Asset advisory Fixed Charge / Law of Property Act Receivership Services

Our dedicated team of Registered Property Receivers is one of the largest in the UK with eight active Fixed Charge Receivers, often known as LPA Receivers, with a collective working experience of over 170 years in the distressed properties and properties recoveries sector.

Often known in England and Wales as LPA Receivership, this is a cost effective means for securing recovery in certain distressed situations. It allows the charge holder, depending upon the nature of the charge or status of the Borrower, to secure speedy control of the asset. The Receivership process is a highly efficient, cost effective and well proven route to recover distressed loans and to exit. 

Authority is derived from the charge documentation and Ss101-110inc. of the Law of Property Act 1925. It is a long-established exit route for charge holders: it concentrates solely on the security of the fixed charge and is distinctly segregated from the other personal or corporate issues of the Borrower. 

The Asset Advisory Team at Lambert Smith Hampton has dedicated and experienced specialists who are FNARA accredited and RICS Registered Property Receivers, boasting one of the largest teams of Receivers with 8 LPA Receivership appointment takers, several of whom have in excess of 25 years’ experience in acting in such a capacity providing a full national coverage with Receivers based in England and Wales. We pride ourselves on having developed and trained (inhouse) a considerable number of our current Registered Property Receivers and are committed to supporting NARA, The Association of Property and Fixed Charge Receivers. 

Our LPA Receivers have extensive experience of taking appointments over all property classes to include residential portfolios, single residential properties, part built residential schemes, development land, agricultural, retail, offices, leisure, warehouses and industrial premises on an investment and owner occupied basis. Our Asset Advisory Team have the ability to undertake drive-by and desk-top assessments at short notice on all property types providing a national coverage and are able to call upon a wider and extensive network of offices and departmental specialisms at LSH to include an in-house auction team for commercial and residential properties (LSH Auctions), an extensive, planning, building consultancy, land, investment and agency teams, and an in-house management department. 

Our Receivers and their teams are experienced in working with Customers in a prior to appointment consensual approach, which we term “LPA Lite” in seeking to devise innovative strategies which where possible avoid the need for a formal appointment. We often work as part of a team of professionals alongside accountants, insolvency practitioners, solicitors, bank managers and others to discuss and devise suitable and cost-effective strategies.
