Break Clause


A property break clause is an automatic right in law to terminate a property lease at a specified point in time.

Typically, tenants seek to insert a break clause in the lease in order to create future flexibility for themselves. The landlord frequently negotiates stringent conditions under which the lease may be terminated, making Break Clauses highly contentious.

For both the landlord and the tenant, negotiating the terms of a break clause and exercising the right to terminate without redress to the courts, takes forward planning and specialist legal and technical skill.
